By signing this agreement, participants acknowledge that they have received and read a copy of Gordon Square Farmers’ Market Policies and Procedures and agree to abide by the guidelines and decisions of the Gordon Square Farmers’
Market, Market Manager, Market Committee or other representatives of the Gordon Square Farmers’ Market.
Participants agree by signing to accept the following hold harmless clause:
All authorized vendors participating in the Gordon Square Farmers’ Market agree that they are independent operators, and shall be individually liable for any loss, personal injury, deaths and/or any other damages that may occur as a result of the vendor’s negligence or that of its employees, agents and associates. All vendors agree to indemnify and save the Gordon Square Farmers’ Market, Bethany Presbyterian Church, its volunteers, and the City of Cleveland harmless from any loss, costs, damages and other expenses, including attorney’s fees, suffered or incurred by Gordon Square Farmers’ Market by reason of vendor’s negligence or intentional misconduct or that of its employees, agents and associates; provided that, the vendor shall not be liable for nor required to indemnify Gordon Square Farmers’ Market, its volunteers, and the City of Cleveland for their negligence or that of their servants, agents, employees or associates. It is required that each vendor carry his or her own personal and product liability insurance. Furthermore, vehicle liability insurance is required to cover any damage caused.
Vendors participating in the Gordon Square Farmers’ Market agree that a market representative may visit the farm or facilities. Prior notice of visits will be given unless it is impossible to do so.

Gordon Square Farmers’ Market
2011 Policies and Procedures
I. Mission
The Gordon Square Farmers’ Market (GSFM) is located in the Detroit-Shoreway neighborhood of Cleveland. The mission of the Gordon Square Farmers’ Market is fourfold: to build and strengthen connections amongst local growers, artisans and consumers; to educate consumers about the benefits of increasing and preserving local agriculture and buying local products; to provide a market for new and/or small urban growers to immerse themselves in a market, thereby creating a niche for themselves in the local food system; to serve the surrounding neighborhoods, including people of all income levels, by providing fresh, high quality, locally grown produce as well as by providing an environment that fosters social -gathering, -interaction and -inclusion.
II. Location, Times, and Dates
The Gordon Square Farmers’ Market takes place at the southeast corner of W. 65th St. and W. Clinton St. (1 block south of Detroit Ave.) in the Detroit-Shoreway neighborhood of Cleveland. The 2011 Market is open to the public from 10:00am – 2:00pm every Saturday from June 18, 2011 through October 29, 2011 plus a Autumn Holiday Market on November 19, 2011 and a Winter Holidaze Market on Saturday December 17, 2011 which are held indoors at a location TBA.
III. Definitions
a. Vendor means an individual who is a participant of GSFM who has agreed to these rules.
b. Producer signifies an individual or business that sells items that they themselves have grown, produced, created or processed.
IV. Application and fees
a. Applications will be sent out in January 2011 and vendors for the 2011 season will be selected in the March. Additional applications may be accepted throughout the season as space allows.
b. The Market Committee may require site visits for any and all vendors at their discretion prior to acceptance as a vendor.
b. All vendors are responsible for paying applicable taxes and fees.
c. There will be a 5% of total daily sales per canopy or 10’ frontage (to reflect frontage use) fee due to GSFM at the close of market each week.
V. Acceptance and space assignments
a. The GSFM will try to balance the needs of the market (supplying customers with a complete and competitive selection of produce available in season) with the needs of vendors without overloading the market with particular products.
b. The Market Committee will select vendors for the 2011 season based on eligibility and the mission of the market.
c. Each vendor will be allotted one 10’ x 10’ space unless otherwise agreed upon by the Market Committee.
d. Space assignments will be made at the discretion of the Market Committee based upon vendor preference as well as the good of the market. Consideration for space assignment preferences will be given to vendors who have committed to the full season.
VI. Vendor Rules`
a. Arrival, setup, departure
i. Vendors at the GSFM are to park only in the area specified by the Market Manager. Vendors may be required to move their vehicle after setting up.
ii. Space will be allocated to each vendor upon arrival by the Market Manager. Vendors may not begin set-up until the Market Manager has assigned them a space.
ii. Vendors shall occupy only the space(s) assigned to them by the Market Manager.
iii. Vendors shall arrive no more than 60 minutes and no less than 30 minutes prior to the opening of the market and be completely set up by the opening of business (10am). Vendors arriving fewer than 30 minutes before opening will be allotted space at the Market Manager’s discretion.
iv. Each Vendor shall display a sign stating the vendor’s name and location of their farm/garden/production facility and shall have their prices displayed.
v. Each vendor shall provide a canopy or tent, as well as tables and other equipment for their displays.
vi. Vendors are responsible for maintaining the appearance and cleanliness of their assigned space and displays. Vendors must remove unsold produce and clean up their spaces before leaving the market.
vii. Vendors are required to stay until close of the market. Vendors who sell out early should post a sign letting customers know they have sold out.
b. Products and sales
i. Vendors must be the producers of all products they sell. Consignment of other producer’s goods must be pre-approved by the Market Manager.
ii. Vendors may sell at the GSFM only on the announced days of the market.
iii. The Market shall be opened for selling by the Manager using a predetermined signal. There will be no public sales prior to the opening of the market. Sales to other vendors prior to the opening of the market are allowed.
iv. Radical price cutting of top quality produce is prohibited. Poor quality or over-ripe produce must be labeled as such and can be sold for a discounted price.
v. Selling of dairy products, eggs, meats, canned goods, and other processed or potentially hazardous products must meet all legal requirements.
vi. Vendors must comply with all laws, ordinances, and regulations of the United States, State of Ohio, and City of Cleveland. Vendors must obtain all licenses or certifications so required, and these must be displayed at the market.
vii. The Market Manager has discretion to allow solicitation, entertainment, informational, and advocacy activities, but such activities must not obstruct customer aisles or occupy stalls needed for selling by market vendors. Each market, one stall will be reserved for such activities. Vendors may use their own stall for advocacy or informational displays. Amplified sounds (radios, televisions, musical instruments and similar devices) are prohibited unless agreed to by the Market Manager.
c. Courtesy/Conduct
i. With the exception of service animals, no pets are allowed in vendor’s stalls.
ii. Smoking is not allowed at the market.
iii. Vendors are expected to conduct themselves in a courteous and safe manner.
VII. General Policies
a. Market Manager: It is the Market Manager’s job to implement market policies. This includes overseeing market set-up, booth assignments, the weekly collection of fees, providing information to vendors, and insuring vendor compliance of policies. The manager will be responsible for public concerns and vendor complaints.
b. Enforcement of rules
i. Vendors who suspect that another vendor is violating any market rules should report the matter to the Market Manager. Vendors should not attempt to address violations themselves.
ii. The Market Manager has complete authority to interpret and implement policy on the market site. The Market Manager also has the authority to use their best judgment in the absence of a specific policy, provided that such action shall not be in conflict with the general mission and objective of the market.
iii. If for any reason a vendor wishes to appeal a decision made by the Market Manager and no reasonable solution can be reached, a meeting of vendors and the Market Committee will be called to decide the issue.
c. Amendment of rules
i. These rules may be amended by a majority vote of vendors and board members attending the annual meeting of the Gordon Square Farmers’ Market.
